Being Sued HELP!!

I just got a call from Sessoms and Rogers,attorneys,about an account.They are suing me and I know they mean what they say they just sued me for another account in July that I was working on paying but the creditor decided they would cancle my payment plan and sue me!! So I know these lawyers and they will take a judgement out against me they do what they say .I have gotten their letter in the mail and this is for an account that I have tried having validated from collection agencies and when they do not they transfer it and I have never been able to get any of them to validate the account.My question is if I send a request to validate this debt, I will send certified mail, can they still sue me cause the man I spoke to told me they still will that they had as long as needed to validate the debt, which I read is true, but how can they STILL take a judgement out on me without it being validated? This acount is 2 years old and has went from one collection place to another.Just want to know if what I was told is true and what to do from here.


I'm no expert on this, so I'll answer the best way I can and if someone needs to correct or elaborate on what I've posted that will help out.

During discovery phase of this lawsuit, whenever that happens, you will need to request validation then. I would also, however, go ahead and send that DV letter before they do file suit. Make sure you do so within that 30-day period and of course send it certified mail/return receipt requested. Make sure you keep that green signature card you get back and a copy of the letter you sent, so you can take it to court with you when/if that happens. It proves you were at least trying get them to validate this debt, rather than ignoring it.

Someone will be along that is a little more knowledgeable about "discovery" during a lawsuit, so sit tight. As I understand it, however, they will have to validate it then, even if they ignored the DV letter you send now.
