this is not to put light to either one of these, but these are the things i've been thinking about since my husband and i put ourselves in credit collection hell and are trying to fiigure out what to do. why would it be worse to be sued and have the judge determine the garnishment to pay vs claiming chapter 13.
Sometimes we feel we want to just wait it out and see how long it takes before being sued(if at all) then trying to come up with the lawyers fee(which we can't) We truly do not known what to do, but I do lay awake every night thinking. I am thankful for this site, but am sorry we are all in this.


The best thing is to retain your own attorney now! Most collectors will drop you like a hot rock if you are represented by counsel. Better to pay your own lawyer then to pay theirs! One chapter 7 is better on your credit than a dozen judgements and a lot easier on your bank account. I would try consolidation first however.
