I took out a couple of payday loans back in june of 2007. I don't have the exact amount of money that was paid back to them but i do know i over paid them by several hundreds. They called my moms house a couple of weeks ago (not sure how they got that number) but they told her that they was going file charges if i didn't call them back by a set time. At first i was not sure who they was so i called them back. When i called them back i realized what it was for. Since then they have called me 3 times with threatning messages. Saying they are taking my drivers license, filing theft charges, and going to proceed with in my county. This is the number that they leave for me to call back. 888-711-7577. Can they really file theft charges and take my drivers license? And are they collection agency or attorneys (they claim they are attorneys)? Should i send them a letter?

First I would find the contracts that you have with this payday lender. Then I would get all of your reciepts. Put this aside for later. If you have this place address send them a "Validation letter". There are plenty of samples here, just ask. Send this certified register mailed with a return reciept request and make a copy of this letter for yourself. This will end their calls, etc. You need to do this asap.

what state are you in? CMG is a bottomfeeder pdl.debts are civil matters not criminal ones.these so-called attorneys just broke the law stating that.i would do as luke advises.get all the info regarding payments and look into AG and FTC complaints as well.

Send them a debt validation letter. Communicate via mail only. They would not be able to revoke your driver's license, but might be able to seek monies from you in a judgement filed in court. If you get validation and try to negotiate a settlement and/or prove to them that you have payed the debt in full, then you should be OK.

Collection agengies (CAs) are notorious for using slightly illegal tactics to try to scare debtors into paying. I have read many a post about folks receiving letters that appear to be from a law firm, when they are, in fact not. Stand firm, and request validation. It is well within your rights.

SLIGHTLY ILLEGAL????? There's nothing SLIGHTLY legal about any of the threats made to the OP. They cannot revoke his DL and they cannot file criminal charges.

garnish immediately without a court order. listen to SOAPLADY and look into a consumer attorney in your area.also look into your state laws in regards to recording calls.

HOW HORRIBLE!!! On my CR, I have a debt, reported by a CA, about a PDL. If PDL's are illegal, how can this (so-called) CA report an illegal debt? I do admit I 'defaulted' on a PDL, however....I still can't see how the reporting was legal, on an illegal loan.

I like Martin's idea, maybe we should all ban together for a day and flood their phone lines!

I am dealing with these people right now. They told me that since they have my work number and work email address that they could get me fired. First I talked to a Ms Whitmon and now Mr Montgomery has been calling me. I talked the the director of my company to ask about this and he is going to file a police report and a protective order against these people. They are breaking all of the laws set forth by the FDCPA. I will be filing suit with a consumer attorney and CMG will be paying the debt off and paying my legal and court fees and will owe me money for harrassment according to the lawyer. They are a bunch of lawbreaking idiots who like to threaten people to pay something that they do not owe.
