A lawyer for the car dealership that we bought a car for back in 2001 and was repo'd in 2002 is taking us to court to determine our vaules status and what are "worth" is. Is this legal 6 years after the car was repo'd?? They garnished my husbands wages in 2005/2006 for 14 months and got more then $4,000 from us. They stopped garnishing his wages & a year later they had me come in for a evaulation to see my "worth", how much was in our bank account, and what are personal property we had they could take for payment. I went & then nothing happened afterwards for almost 2 years. They then contacted my parents wanting them to come in for personal information on my husband & I and how much they thought our "worth" was. Well after my mother sent them a letter saying it was causing hardship between families, they stopped bothering them & then contacted us 4 months later saying we have to come in for a evaulation or we will have warrants for our arrest (bench warrants). Is this legal?? I live in Ohio.

Thanks,
Jessica

First question, when they garnished your husbands wages, did they have a court judgment against him? If not did he allow this garnishment?

Do you have it in writing that they where going to issue a warrent for your arrest?

Did they actually file a lawsuit against you? do you have a summons, docket number? If so did you call the court house to see if it is legit?

The Statute Of Limitations in Ohio is 6 years for an open account and 15 years for a written contract from the date of last payment.
