I have a question for someone. I have a credit card that was opened on 12/2004. It was charged off Sept/2005. On my credit report is says that the date of first delinquency is 2/2005 and the date major delinquency first reported is 8/2005. It says date reported as 8/2007. I do not remember when the last time I paid on this account was. It was obviously before Sept/2005 since that is when it was charged off. My question is does SOL apply to this and does it apply to where I lived when I opened this account or where I live now? I lived in Kansas then and I live in South Carolina now. I got a call from a lawyers office telling me they want to know where I live so that they can serve court papers for Sedgwick County (kansas) on me for a judgement against me. I did not tell them where I lived. What do I need to do? This all confuses me. The are trying to tell me that I owe them $1500 but will settle for $600. Wanted me to give them a post dated check for it. Told them to shove it and hung up. HELP!!

what# comes up on your caller id?i don't know if i would have said it that way,but you did the right thing in not giving them any information.if you can give me a # i can find out the identity of this place and maybe an address to send DV and C&D letters.

couldn't come up with anything based on the phone#.did they say what supposed law office they are?it sounds like either a rent-a-lawyer,or a bottomfeeder saying they are a law office.i would check your credit report.go to annualcreditreport.com.you can see all three credit reports for free.

The guy I spoke to was not very easy to understand he either called it AC & Grube or Lacy & Grube. I have my credit report here that I got in Dec. and all it says is that the debt was transferred or sold to another lender. I'm just not sure what to do. He made it sound like I should know what he was talking about and I had no clue. The address he had for me was one I haven't lived at in about 2 years. He had another address for me that he said was not 100% verified (didn't tell him yes or no on it) but it's the address that I used to live at in Maine but I moved in September to South Carolina. He said they are going to garnish my waged (I don't have a job). I just want to know what I should do.

so your saying this person had a thick accent?i will try to get more info for you,but this sounds like a JDB trying to scare you into paying without proper validation. i just checked both and nothing comes up.this does sound like US NATIONAL BANK.if this thick accented mope is in INDIA and can't do a thing to you i wouldn't talk to him again.

The guy said his name was Ernie Ortiz. I know that the original creditor was Household Bank (HSBC).

well that is a fake name.if this jabroni had a thick accent then this is a scam.i know it shows on your credit report, but the place that bought it is a scam in india.just try not to talk to him unless he is willig to send you something in writing.i couldn't find an address because it is more than likely in india.

Should I contact the clerk of courts for Sedgwick county and ask if there has been anything filed against me?

yes,it should bring you peace of mind.that is how these places work.threaten everything.then call back like nothing happened if you don't give them what they want.please check your court clerk's office to see if anything was filed.

Thank you so much for your help. I was reading some other posts and basically because they do not know my current location (which they could find if they really wanted to) they can't serve me with court papers and thus if a judgement is issued against me I can probably have it vacated for not serving me with papers correctly and not filing in the place that I live, it that correct or am I not understanding it correclty?
