My DV Letter Has Been "Refused" - Now What?
Date: Thu, 03/26/2009 - 11:50
Well, my Certified Return Receipt Requested letter I sent to JD Enterprise and Financial Services was just returned to me by my Postman. They wrote "Refused, RTS" on it. There was also a sticker on it saying "Return to Sender Not Deliverable as addresses Unable to Forward". THe address I used is the one on their damn dunning letter.
So now what? As I mentioned before, these choads *know* I never made that imaginary payment in 2005, and the SOL is way way past.
I want this off my credit report as well...
They have not called since I called their bluff on the SOL (and confirmed what I already knew with the OC). SO I was just wanting to CYA here. Any suggestions or ideas? And who do I contact to get their crap off my credit report?
Thanks again guys. Without you all, I would most likely STILL be dealing with them and harrassed by them.
Patti

Have you tired disputing it with the credit reports as "not yours" That's the easiest way to get it off your reports. Ohh I also just googled them apparently they are a member of various groups. I'd start my complaints to ACA International Here's their website

it may be that the address is just old? Have you googled the company and looked for their address? You could also call them and get a good address?

That is the address I used. They clearly chose to refuse this. Why, I do not know. I just want to know what to expect now. Can they still harrass me? I am thinking I need to report these choads to the BBB. Or someone.
I want them to be out of my life. Them refusing my DV letter is not a good indicator of this, is it?

No chance. The address I used (and the one mentioned above) match EXACTLY to the one from their so-called dunning letter. I just called and asked for their mailing address (from my neighbor's house) and verified it is indeed their address.
So they flat out refused it. Any ideas on what I should do now?
Thanks-
Patti

i would report them the BBB, attorney general, anyone you can find. you have the right to validate. do you have an email or a fax number? did you send it certified? i wonder if it would hurt to send it with no return address? but that way you do not have proof on them recieving it.

Beal, I sent it Certified Return Receipt required. They wrote REFUSED right on the envelope.
I am going to report their asses. Because maybe then next time they will not harrass and insult another person just because they were clueless enough to buy some bad debt...
So I am guessing here, but they should NOT be calling or mailing me again, right? Since they would not accept my DV letter, they failed to reply to me within the 30 days of said request? I want to ensure I have all my ducks in a row before I go and file complaints...
Interesting thing about Googling these choads; evidently, they are hiring. I wonder what credentials they are looking for? "Must be able to insult intelligent people and yell JUST PAY YOUR BILLS BITCH!" into the phone, and possess the ability to talk over you, no matter WHAT you are saying, and even when you are speaking in an even tone and referring to said choad as "Sir". Yeah, I am a little bitter...

Also complain to the agencies that they list on their website. I just shot off a complaint against someone that is listed with ACA that listed my debt that was in dispute with the credit reports, and even after disputing it they immediately sent it to a collection lawyer.

A choad is, according to Websters,
"Synonym for `p e n i s' used in alt.tasteless and popularized by the denizens thereof. They say: "We think maybe it's from Middle English but we're all too damned lazy to check the OED." [I'm not. It isn't. --ESR] This term is alleged to have been inherited through 1960s underground comics, and to have been recently sighted in the Beavis and Butthead cartoons. Speakers of the Hindi, Bengali and Gujarati languages have confirmed that `choad' is in fact an Indian vernacular word equivalent to `f**k'; it is therefore likely to have entered English slang via the British Raj. "
In short, another term for dickhead. :D
So is sending them an email an acceptable for of DV then? I don't have a fax machine and already spent $5.32 on the CRRR letter, but will gladly spend more money to CYA.
So which would be better?
It kinda pisses me off that I am having to jump through hoops to get them to get this letter, when we *both* know that there was no such payment in 2005 as they claim, and they are, TSOL...

You could also file a complaint with the ACA International and let them know they refused your Debt Validation letter if you don't want to send an e-mail. I would fire one off via e-mail to cover my own butt, just to be on the safe side.

i agree with beli2005, i would really fax and email them. you need proof that you requested validation or they will simply say you never asked for any, which is basically like admitting to the debt.

I will send it FedEx. The thing with a fax or email, they can still play the "I never got it" game...
So me having the letter in my hands that says REFUSED on it is not proof enough that I tried to send these idiots this?
I'll go over to FedEx on the 3rd when I get paid and send it off. Anything to get these jerks off my back (and credit report).
Thanks again-
Patti

I just re-printed the original letter I sent them. Changing the date and adding, "Since my previous attempt to send you this Debt Validation letter was refused, I am further attempting to send you one via FedEx."
My question is, can they refuse this one too? I highly doubt this place has a receptionist. I will check it as Signature Required. I am guessing once they see who it is from they won't accept it again...
Just be on the safe side, I will have my friend write the address and info on the FedEx slips. I will not give these bottomfeeders ANYTHING in my own writing, even block printing...
Thanks again,
Patti

I agree, sometimes i use my PO box as my return address and no name, i think you could do the same with fed ex, and also they do not have as much time to think about the address, they just basically have to accept it or refuse it on the spot.

Sorry but if they refused the other one, chances are they are going to refuse the Fed Ex one as well. I'd be more inclined to send an e-mail to them with a Return receipt attached to it so you know that they got it and file it away with your other documents, that way your not waisting any more money on this then you already have.

OK, I will use my home address, but for a name, I will put "P-Mums, Inc.". THAT should throw them for a loop I would hope (if Fedex doesn't require my name).
I will see on the 3rd what FedEx says and let you know what the outcome will be. I really don't know why they would refuse the letter. But hey, not like I am looking foward to speaking with them again...

So I am guessing I should still send the FedEx letter to, to CYA?
I just want there to be NO way these scumbags can come after me... and have all the proof I need if they try...
Thank you again,
Patti
Faxes get a confermation page plus you can email it and have it
Faxes get a confermation page plus you can email it and have it to where you get a confirmation email upon them reading it. I know it spends money, but send another one CMRR...keep the one with the big refused..that is golden.
Also check your state recording laws and call them after you faxed and get them to admit to getting the fax recorded, then when you haul them to court you can show the judge just how baddly they wanted to avoid your legal validation letter.

Good one nascar!
Also, instead of sending it certified mail, the post office offers a "Delivery Confirmation" option for a buck or two. That way it doesn't require a signature - therefore they can't refuse it - and you have proof from the PO that it was delivered! :)
