My trial/court date is about a month from now....

Just got a couple of questions relating to what motions I need to file to get the case dismissed. The judgment has been vacated. Plaintiff really has no proofs. I have been advised here that I should file a motion for case dismissal with prejudice. On what grounds??? Or I first need to file a motion for discovery? If plaintiff can't provide proofs, I then file a motion for case dismissal??? I need to know which comes first. I will be heading down to the court house next week to ask for some assistance as to how to file a motion and etc.....

If you have already filed a Motion for Discovery (if not, do so) then you can ask for a Dismissal with prejudice (that means they cannot sue you again for the same alleged debt). They have to prove it is yours, if they cannot, then it is hearsay.
