Hello,

I have a CA call me two days ago telling me that I had a debt stemming from 2005 when I was a minor. I got the information and called the company I had the debt with, which is an ambulance company and asked why my insurance didn't cover this. For whatever reason the insurance did not cover the ride and now I am stuck with the debt. (Frankly, I do not remember using this service). I live in the state of Kentucky and I want to know my rights. I did not receive any initial bills because I moved away for college and now the debt they are trying to collect is x2 times the amount of the actual debt. What are my rights and what actions should I take?


First thing you need to do is to validate the debt. Did they send you a dunning letter? They are required to send it out within 5 days of initial contact with you. When you receive the letter, send a debt validation letter to the address on the letter. If you do not remember using the service, they may have gotten names mixed up. Skip tracing does this some times. You need to get them to prove the debt is yours. If they validate, then you should set a payment arrangement with them. Get it in writing, and stick with it.

They have not sent me a dunning letter, however, I did ask for one today when I contacted them. Once I receive the letter, I will send a DV. If the debt is truly mine, I will pay for it. It boggles my mind that my mother cannot remember the insurance company and I want to know why they denied this particular claim. Does it even make since for me to higher a lawyer? I am a college student trying to maintain a magnificent credit score and this is not making it any better.
