Acceptance DID NOT Validate and Reported on Credit Report!!!

So almost a month later I’ve received what’s supposed to be a validation letter from Acceptance. Clearly, this is not a validation letter.

The letter states:

Dear:

Thank you for your request for further validation of your above mentioned account.

Enclosed please find an account statement prepared with information provided to us by the prior creditor.

Please contact me so that we can work toward resolving this matter.

This is an attempt to collect a debt and any information obtained will be used for that purpose.

I’m in California. The SOL here is 6 years, and the SOL has expired on this account.

I've finally received a credit report from Experian and TransUnion, still waiting from Equifax. Acceptance has “opened an account” with TransUnion back in 2005 and last reported on 4/2008. There’s also the original creditor information, the account was opened in 99, last reported 2/2002 and closed 06/2001. On both Acceptance account and the original creditor account, the TransUnion report states that “This Account is scheduled to continue on record until May 2008” - So is this the date when both accounts will be removed from my Credit report?

Now, I have not contacted anybody in 2001 nor 2002 nor EVER! So, why does the credit report states things such as “last reported 2002”? “Last transaction 2001”? I don’t understand these details.

Basically I need to know what to do next!! Help!!
Do I need to send Acceptance another Validation letter stating that they have not validated anything I have requested?
Can I dispute with TransUnion that I’ve never, ever had an account with Acceptance? That they had no right to report anything back in 2005 and reported again in 2008??

Also, Acceptance appears with many different names on my report as “inquiries”.

Please, I would truly appreciate feedback and any help you can give!!

Hi ladybug!

I'm still waiting for the Equifax report. Acceptance appears on my Experian credit report as "Date Opened" 8/2005, "Date of Status" 9/05, "Reported Since" 9/05, "Last Reported" 4/08 . Status: Collection Account past due as 4/08. As for the account for the ORIGINAL CREDITOR I've noticed that it states a recent payment made but doesn't give me the date. I did not make any payments!

As for my TransUnion Credit report it only shows the name of the orginal creditor, and it also states that this account might be removed on 5/08.

I'm still waiting for advice from others!

I don't have any proof of my last transaction (payment)to the original creditor - unless I contact them which I don't want to at this point! I just know for sure that I did not make any transactions nor contacted the original creditor since 2000.

I REALLY need to know what to do next as far as dealing with Acceptance. They did not fully validated the debt (please read my first posting). What should I do now?

Ok, what they gave you is only good for toilet paper! Validation MUST come from the Original Creditor! NOT a rehash of their own records. They must provide:

Signed contract, statements for the life of the account, proof they are legally able to collect in your state and proof they either own the debt or are authorized to collect upon it from the owner of the debt.

Dispute the accounts with the CRAS and when they verify you have em. You can then ask for the method of verification from the CRAs and when they can't produce such, you can not only sue the CA but the CRAs as well.

Then you can send a 2nd letter to the CA and tell them that they did not send proper validation and that they further violated by verifying un-validated account with the CRAs. Tell them that now unless they immediately close out the accounts and remove them from the CRAs, you will file suit against them. Give them like 15 days to comply.

If they don't comply, take them to court!
