Account Garnishment
Date: Sat, 11/19/2011 - 10:35
I'm inquiring on behalf of my girlfriend and for my own curiousity. My girlfriend's savings account was garnished without her knowledge. She has never received any court summons or any mailing paperwork warning or letting her know of any impending actions toward her. I know this for sure as we've lived together for quite some time. It is my understanding that anytime a garnishment takes place, it comes from a judgement handed down from a judge. Apparently this is an issue from 9 years ago when she was 20 and she has never received any notices. What recourse do we have to find out what went wrong and why she wasn't contacted? If she wasn't contacted and the notices were going to a previous address or never got sent out than would she be able to get the judgement vacated? Any advice would be appreciated.

You need to look the case up online to find out when and how she was served. It is also possible that she was served by publication.
Garnishment
To whom did the garnishment money go? The bank should have paperwork and should furnish it to your girlfriend. I know the IRS can take money from accounts without a judgement. Tell us who garnished the account because that may help us to give you the correct advice.
