Garnishment of bank account SOL expired

I just received a letter from the local court and bank saying that I was sued by Midland Credit Management for a past due balance owed to Capitol One credit card that was issued in September 98. Last time I made a payment was late 98 early 99. I thought this was past the SOL. I never received a summons to appear. I just found this site and I see that you will be able to tell me what I need to do to resolve this.

Which state are you from? Most likely the SOL has expired but you may still need to check. Now, if it is past sol and you have never received a summon, you may file a motion to vacate the judgment. Check with your country court for details.

I'm in Ohio for the last 9 years..I was in Michigan when I opened the Capitol One account in 97.
