So about a month ago I received a phone call from someone claiming that they were a process server in my county and they had me on the schedule to be served that day. They told me to call a phone number and discuss my options if I did not wish to be served. I called the phone number and they answered the phone 'claimants office' I gave them my reference number, name, street address, last 4 of ssn and she informed me that I owed $1022 to Citibank. First off, I had a Citibank account but I never received ANYTHING in the two years since it has been closed saying I owed money to them. Secondly, my Macys card is through Citibank but that account is in collections with a different company and the payoff is only around $500.
I told her that I had no record of owing this money and that I needed the debt verified. She told me they had it in their office for some time and the only way I could stop the service, which she said was scheduled for Wednesday not that evening which was Monday) was to make a payment.
I agreed to make a payment and she said they would reduce the amount from $1022 to an even $1000. I agreed to 4 payments of $250 and gave my prepaid card info. She, at that time, said the company was UMS.
Unfortunately, I had some unforeseen medical bills and couldn't make any of the payments.
My last conversation with them was today after receiving a phone call and a voicemail telling me if I did not make a payment today I would need to get a lawyer.
I called them and explained the situation and she told me it was a 'stall tactic' on my end. I told her I wanted to pay this debt off but I did not have it in my account today and I asked if I could make a payment on Wednesday ( day after tomorrow )
She flat out said no. If I could not make a payment today, they would continue to file a 'lawsuit' and I would be served.
So, what do I do? Is this a legitimate threat? Do I need to get a lawyer?
My concerns are:
1) I had no knowledge of this debt
2) I never received anything by mail
3) Originally they said they were UMS, today they said they were URS
4) Who notifies someone before they serve them?
The phone number was 1-877-343-2890
The 'courier' for service was Sam
The agent I spoke with was Rachel
The lady who left a voicemail for me today, telling me to get a lawyer was Kaitlynn


1. Legitimate process servers do not call beforehand to inform you that they are coming over to serve you.

2. You had no idea who you were talking to on the phone. Never give away sensitive personal information like your card number or SSN to a disembodied voice on the phone. Thats just asking for trouble.

3. Since you had no knowledge of the debt and you were almost sure that the Citi account was being collected on by another CA, you should have asked them for a physical address and hit them with a DV request. Also, CAs are required to send you a dunning letter prior to beginning collection activities. You never received anything in the mail.

4. Thankfully you have not given them any money yet. Even if it is all legitimate (which I have serious doubts about), you can still make settlement offers after you have been served.

5. If they again threaten to send the process server if you do not pay immediately, ask them to send their server and meet you at the county sheriff's office with all the papers.

What a crock...process servers do not call in advance....this screams scam right there!!! I looked up the phone number...877-343-2890....could find nothing.

Have you pulled a copy of your credit report?? DId you call Citibank?? Why on earth would you make payment arrangement on an account you know know nothing about? Did you ask them for their address???
If you must call them back...as for their mailing address...

Same number called me today.Sam the courtier who's in my area will be serving me by Thurs at 6 call the number to find out into. Called they said I m being sued by a cash advance place that I didn't pay off. Being sued for 3,800 dollars for a 250 loan. But I could settle for 500 before I get served. I almost fell for it. Screw them. They can go f#$% themselves.
