Dealing with the STUPID people at Ace Cash Express

My husband had a payday loan with Ace Cash Express...we live in Texas, yes, the one with the worst LAWS concerning payday loans out there... But we are the ones that took out the loan and we are the ones responsible for paying it back, I know. Anyway, their collectors are some of the worse animals out there. I think they are a special breed. I have read other blogs that talk about others that have dealt with them that have had some of the same type of experiences. Sigh... anyway, this guy Mr. Hernandez, called me on my cell wanting me to take his number down and have my husband call him back. When I asked what it was in reference to, he said that since I am the "girlfriend" I am not privy to that info. I said that I was the wife and not the girlfriend and he said, "maybe common law, but that doesn't count". Well I was peeved by then. I asked if he'd like to see my marriage license and he hung up on me. I then received another call from him that said that he was going to send someone to my husband's job to "teach him how to pay his bills". I was livid by then. I called him back and he was SO rude and just slimy. According to what I have read, they can be that way because they are not a collection agency but the actual lender. But still, very rude. After a lot of talk and rudeness, he told me that we had to pay $600 by Friday (today) and the rest by the next Friday or he'd have my husband arrested for a fraudulent check (it was a storefront). Long story short, we settled with them and payed what we borrowed and no interest, but we can never borrow from them again (like I care). My question is, I asked him for a letter stating that we were "settled" with them and he will not send me one. I have tried to call his supervisor and can not get a call back. When I called today, I was told that I was not entitled to one, and that I had to take their word for it that they would not come after us for the penalties and late fees and interest. They said that as far as they are concerned, we paid $1000 and it is taken care of. Can they refuse us this information? I have my receipt where I paid them, but that doesn't say that the account is paid in full. Any suggestions?


Well, you are SCREWED little sister.

Your first mistake was taking the PDL, but you know that now. Too bad everyone else doesn't.

Your second mistake was not getting this letter up front before payment. But you know that now as well.

My guess is that they will wait a while and then chase you for the rest. As for the rest, they can't put your husband in jail for non-payment of debt. If you knowingly bounce a check, they might be able to make a case but no prosecutor would probably file it.

Good luck and stay out of those places...pick up a paper route if you have to make extra money. You can't borrow your way out of debt.

That's what I do! I've been doing it Detroit this week. Did I meet any of you?

Read my handle, would kind of be anti-GBD to register. Then I would have to be something like member by design. That makes no sense.

Look, I wasn't being rude. I don't see how you get that I was being rude. It was merely statements of facts.

1) PDL are bad ideas
2) You screwed up by sending them payment before getting anything in writing.
3) And finally some sage advice that you can't get out of financial trouble by borrowing.

Where did you get rudeness out of that? I am guessing that you used the same logic when reading my post during your illogical debt binge. Now I am being rude.

You might be able to get away with passing worthless checks on internet loans, but a storefront can turn over an actual instrument to the local DA. This may not be an idle threat. Good thing you settled with them.

A bounced check is generally handled by a magistrate and settled in civil action. The PA (Prosecuting Attorney) will step in if they have reason to believe that there has been intent to defraud based on a pattern of activity or a large amount. This is also dependent on state statutes.

The DA (District Attorney) will handle cases when a PA is not available.
