To Whom It May Concern: This letter is being sent to you in response to a recent request for payment to your company. In early March (3/21/06), I sent certified letter, (which your company signed that they received) in which I asked for VALIDATION of my debt. You company failed to provide me with validation. Please note that your company did not validate the debt, the debt is out the SOL and I am no longer legally responsible for that debt. Please note that any further attempts to collect will violate the fdcpa. I am again requesting that you remove the invalidated information for all of the 3 major Credit Bureau’s (Equifax, Experian or TransUnion), as it constitutes fraud under both Federal and State Laws. If any negative mark is continued to be found on any of my credit reports by your company or the company that you represent I will not hesitate in bringing legal action against you for the following: • Violation of the Fair Credit Reporting Act • Violation of the Fair Debt Collection Practices Act • Defamation of Character I would also like to request, in writing, that no telephone contact be made by your offices to my home or to my place of employment. If your offices attempt telephone communication with me, including but not limited to computer generated calls and calls or correspondence sent to or with any third parties, it will be considered harassment and I will have no choice but to file suit. All future communications with me MUST be done in writing and sent to the address noted in this letter by USPS. |
There it is, Thank you in advance for any info regarding this matter--

Sounds great Krista.
Send this certified as well, and keep a copy of it, and the receipt in a file.
Good luck!

Just a quick tid bit. You are legally responsible for the debt, they just can't legally activly colect it.
Don't think the SOL resolves you of responsibility to pay back somehting you took.
My other post didn't post.. but I also wasn't logged in. Yo
My other post didn't post.. but I also wasn't logged in.
You are still legally responsible for that debt. The SoL doesn't mean you don't have to pay for somehting you took.
The SoL just prevents active collections.

I never took anyting- The debt isn't actually mine- My credit card was stolen by a roommate- I filed a police report and filed with the credit card company (who told me there was NOTHING I could do). In fact, the court orded my old roommate to pay me (the balance due)-- however, that person filed bankrupt, listing me as a someone he owed- so I never got the money- This debt is NOT mine- the court ackowledged that- but citybank wouldn't. FYI I tried to settle with them for a lesser amount, they refused to settle-

OK, the card was stolen and you went through the process of getting it reported Lost/Stolen right? So if you kept that police report it should be almost a walk in the park to get it removed from your credit report which you should have done when you first noticed the negative remark onto your credit report.
Citi Bank has an entire department who deals with this type of stuff on a daily basis. What you need to do it call them again and speak with someone who actualy knows what they are doing because it sounds like you spoke with a CS flunkie.
Whoa! Sorry for the original misunderstanding, but your old room
Whoa! Sorry for the original misunderstanding, but your old roommate is a low parasitic scumbag! You really should continue to dispute that debt!
I did everything that citybank told me to do- I tried and tried-
I did everything that citybank told me to do- I tried and tried- they eventually turned to something like a "charge off" on my credit- for years (like 4 years)--- then recently it was sold to Midland-
Also, I can't find my original paperwork- I have lived in 4 different states in the past 6 years and have non-stop medical issues- this was the last thing on my mind to be concerned with- until march with Midland notifed me of the debt-
Trust me I would do anything to take care of this- I had my 2nd brain surgury in Feb--- I need to take care of myself not this old debt from a loser who stole from me...
One more thing, the debt was sold from Citybank to Midland- It
One more thing, the debt was sold from Citybank to Midland- It just showed up negative on my credit last march (06)- It didn't show up neg. until this point- And actually it showed up on my credit PRIOR to midland sending me notification.
