Advice for an old debt in GA
Date: Tue, 01/31/2012 - 11:22
I'm one of many that got in credit card trouble in college. I think I'm close to getting two collections out of the way but I need some advice.
Here's my situation. I have two revolving lines from BofA. On my most recent credit report (this month), it states last activity as 10/05. By the way, originally I owed 7200 and 3900. So, I can't see the date I stop paying and it was moved to collections.
From the same report, Asset Acceptance took over in 6/08. I would like to also mention, I've never once spoken with AA and have ignored their calls since they bought my debt from BofA.
Now, I realize what I'm doing is more to game the system and I'm not proud of myself for doing so. In fact, I've lived credit card free up until two years ago. I have a car loan and a cc with a $500 limit to rebuild my credit with good tradelines.
My question is this, how can I be certain when the SOL started? Would it be in my best interest to challenge or validate this with AA?
Obviously I don't want to be sued and if it's better to just wait, I will. If anyone has advice for this deadbeat, it would be greatly appreciated.

Yes, I'm in GA. I believe GA has gone to a 6 year SOL from a lawsuit AMEX won.
Regardless, I did stop paying in 2005. This sounds dumb because I think I know the answer but I'm not sure if I need to account for 6 months past 120 days to count SOL or if it's just 6 years after last activity according to the current credit report I have.
Obviously I want to avoid a lawsuit and if waiting a few more months is best, that's what I'll do.

I wanted to add, assuming I was clear of the SOL, would my best move be to challenge Asset Acceptance to get them to stop reporting this or start with the credit bureaus.
I will say I haven't received a collection letter or phone call from AA in a few months now. However, they did an inquiry last December.

Personally I would just lay low....challenging a debt that can legally report can open a can of worms.
