Need advise on very old bill

I'll tried to make this short. Last week I recd a call from a CA re: a 4/07 bill. I ask who the creditor is & they advised it was a local vet. (This vet requires 1/2 payment when the animal to dropped off, and the remaining half upon pick-up. I've never left their practice owing them any money.) I called the vet speaking with their a/r person. When she pulled up my name, she said there was not a balance and didn't know why the collection people were calling me. I was with a rescue organization 3 yrs ago and I used this vet for rescue dogs I fostered. I ask the lady to look under the rescue's name to see if anything was there. She did and surprise there was an outstanding balance. Apparently their staff had entered charges to this old acct in error, so when I checked out this charge didn't appear on my acct. I have no idea who they have been sending the bills to all this time, but the collection agency connected the rescue organization to me by the address on the acct (which was correct 3 yrs ago). The vet's a/r person last Wednesday was all peaches & cream and I made arrangements to pay the balance..keep in mind I had no invoice; had never recd a invoice. Today she calls and its a different story and a different amt due. In fact she was pretty short with me...said the debit was going against by cr report and that there was nothing she could do. WHAT! I called the collection agency and she said she had a different amt...now she wants the vet to call her!
So..1)fees were applied to the wrong acct by the vet's staff; 2)vet's staff tried to collect fees from rescue organization who never replied to statements; 3)vet's staff turns over to CA who connects to me because of old address....I'm having a charge applied against my credit for an old balance I did not know even existed until last week! I'm going over to the vets office after work to see these people face to face. What rights do I have? Help!!


You need to send a debt validation letter to the CA requiring them to prove the debt is yours and the amount is correct and it is not beyond the statute of limitaions. A template can be found under the do it yourself section of this site. Also include a cease communication section telling them they are to contact you by US Mail only. You will proably never hear from them again. Who is the collection agency?

BCS in Greensboro NC. Thing is, I have no doubt the outstanding bill is for my dog..its just that their (the vet's) staff put the fees under the wrong account so that when I checked out it did not pull to the correct account; their staff continued to invoice
the wrong parties for a year! I had no idea until last week that any monies were due the vet for this dog. The CA connected the debt to me by nothing more than an address. When I spoke to the vet last week they did not show an outstanding balance..zero, zip, nada...associated with my name. My dog was there during the period of time in question, she did receive services, I did pay the amount I was told to pay, however, now it appears it was not the correct amount. I'm willing to pay what is due for her treatment, but I am not willing to have my credit report marked for an outstanding balance I did not know existed. Nor do I think I should have to pay late fees. This is crazy.

"Tell the CA in your letter that you wish to deal with the vet directly. Put all the burden of proof on them and if you still feel you have a moral oblgation to pay the vet, pay the vet directly."

But the vet has done an about face...after giving me a verbal agreement last week that everything was ok, not to worry, payments will be ok, they said the debt has been turned over to a collection agency and put on my cr report; nothing we can do..click. What!? No mail, no phone calls (the vet does have both my work & home numbers), no nothing since April 07. Is this legal? I want to go over to their office tomorrow and talk to their office manager...am I wasting my time? I must have some rights.
Do I not have any rights?

I wouldn't go over there and meet face to face, unless you're very certain of your ability to control both your temper and your mouth. Set out the facts as you see them in a letter, state your position, and tell them what you're willing to do. Then send it to them CMRRR. Having a paper trail can only be to your advantage. Having proof of delivery is a Good Thing, too.
