so my phone rings around 6:20am this morning. of course i answer it because i know no collection agency in their right mind would be calling me at this hour. and to my surprise its that collection agency from india claiming to be a law firm for american credit services asking me for my attorney information. saying on monday they are filing legal documents against me. i proceeded to tell the lady if she really was from a law firm they would not be calling me at 6:20am due to fdcpa rules and regulations, she said are you going to assist me with your attorney information, i said no i'm going to sue the sh&t out of your company for violating fdcpa laws, advised her to never call my number again and hung up.
the thing that sucks is i know i cant really do anything but yell at them. even though they claim to be american credit services they are definetly not in america. they have been leaving these long scripted messages on my answering machine for months now talking about how if i dont return this call immediatly all they can do is wish me good luck. sorry if this sounds like a rant i just had to get it off my chest.

Why can't you do anything but yell at them? If they are claiming to be an American company, then they must have an American address, right?
If so, then you need to first check the laws of your state regarding the recording of calls such as this, and if legal to do so, record the calls & messages and use them to build a violation of FDCPA laws against them.
Just because they may have outsourced their call center to India (such as many American companies are doing), doesn't mean they aren't an American-based company, and therefore, subject to American laws.
