I have a debt with American Express 10,000+ in Florida. My car has 3 payments left *1600.00 , a Mazda 2005 Tribute 4x4 worth about 8300.00. The exemption in florida is 1,000. I do not want to lose my car! I am in foreclosure, my credit report is tanked with all my cards...20,000 x 3 citi, chase, not yet boa...it's all disintegrating. I received the call from Martin and Hunt, first call thursday, August 19...the post on the internet says they are an aggressive firm...i'm not answering the phone i'm unemployed in medical crisis no income. I am very scared..
I'm leaving the state of florida at the first of the month...if i take the vehicle out-of-state = can they seize it there if it still in my name if a judgement occurs?
Will they take my car for the debt even tho' the value is not enough to cover the debt?
Can I pay off the car and title it in a relative's name out of state before something happens? What is the solution here?

Hi, I live in Florida, also. My best advice for you is honestly file bankruptcy, especially if your in foreclosure. If you only have 3 payments left on the vehicle, pay that off, odds are they wont take it. Being unemployed, medical problems may work in your favor also in a bankruptcy, contact your local Legal Aid society, most counties in Fl have one, in that situation you may get free legal help in filing also.
