Amex debt in The US

Hi,

I have 20000k in debt with Amex from the US and currently live in Canada. I wanted to know if I could be liable to pay this back.With the current economic situation I dont have the extra money to repay the debt. Does the law in the US permit it to be collected in Canada. Also how would they be able to find my information and other details as well.If any one has any idea on this please do let me know.


SC you mean a US debt may be difficult to collect if the consumer relocated in Canada.

I am no expert, but if the US debt collector gets a default judgment against you, you may be subject to collection actions upon your return to the US within that 10 year time frame. However that depends on how long that US judgment stays on your US credit report, the SOL, and the state laws you reside in. There are so many variables to that can come into play. Ultimately your US credit report will take a major hit due to nonpayment of the debt, but your Canadian report will most likely not be affected. I believe they differentiate as far as reporting is concerened.

I would definately seek legal counsel on this question to clarify it further. In the meantime maybe DebtCruncher or Nascar_D will be along to offer their advice.

As far as I know, since the Governments of the two countries are working together on several areas, they can collect the debt in Canada. Again, if you apply for a new credit line in Canada, the creditor may check the US records. They may transfer the account to a CA in Canada, who will collect the debt on their behalf. Moreover, when you apply for citizenship in Canada, your credit history in US will be checked.

No, your US credit history is NOT checked when applying for citizenship. Or the other way around, Canadian coming to the US.
People crossing borders to live can request to have their credit reports pulled for getting credit....I know a lot of canadians living her in Minnesota have their canadian histories pulled when applying for a mortgage...but they have to request and pay for it..

I think it can go either way depending on your state laws regarding a official summons.

Please read this thread which is pertains to unanswered summons when served.

Now as far as you being out of the country when you are served I do not know if there are different guidlines regarding that process. Others will be along to offer more help shortley.
