I got served today with papers from Capital ONe....can someone tell me how to answer the summons? I was working with a debt settlement company that did nothing to help me and now I am stuck.

Did Capital One know that they where being paid by a debt settlement company, or where they on the plan. If they where on the plan, then I would call your settlement company asap and send them a copy of your summons. If that does not work, then I would get in touch with the circuit clerks office where the summons came from and tell them about your settlement situation.

I cancelled the debt settlement company at the beginning of this month but Capital ONe did know because I recvd a letter from Captial ONe stating they recvd teh debt settlement companies letter. It's ridiculous, the collection agency/lawyers office said they would accept 85% settlement due in 30 days and file a dismissal and remove the attorney's fees but it is 85% of the balance now which is ridiculous. I told them there was no way I could come up with that settlement in 30days!

First of all, are these papers legit? Some of them can make documents look pretty legit.
If these are just papers from an attorney/collector, you still have room to negotiate.

If this is a real suit- be sure and file your answer to the courts in the time frame they give you. You can put, if there is room, that you were in a debt settlement company, but they did nothing in regards to your creditors.
