should I send validation before answering summons?

Just wondering if I should send a debt validation letter before answering the summons?? I called court house and I have 21 days to answer (as of 2 days ago) so I guess I was just wondering what to do next. I really can't afford to hire an attorney unless someone knows of some that are in Michigan that don't charge an arm and a leg. So basically I have to do all this myself. Thanks for any advice in advance.~Angie


You can ask for validation in discovery, and when they can't produce it, you can motion to dismiss with prejudice. Also make sure that if they try to use an affidavit as validation, you object to it being heresay.

DVing now after they filed suit is kinda pointless. Others will come along with much more knowledge about this then I.

I got a summons from law office of steve and loeb rep.lvnv funding what do i do now? i have no idea how to answer and if i dont answer what will happen

Lmsoo - if it is a real case (Check with local clerk) and you do not answer, they will get a default judgement against you, and with that, they may pursue more aggressive collection activities. Hopefully someone with more exp with these will answer soon, but I'd say you definately need to do something about it

Thanks lawstudent..if I didn't think I was too dang old to start now I would actually consider going back to college and getting a law degree....I find I really enjoy fighting these scum sucking CAs...should make a career out of it! :) But I think 37 is just to damn old to go back to college. :)

Hmm...ok....it just feels weird that my 17 year old daughter is starting college..wonder how she would react to mom rushing into a class, "Hi baby! Mommy has class with you! How neat is that??" :twisted: but you know maybe it ISNT such a bad idea..I bet I would be good at it....I scare some of the CAs now....wonder how bad I can scare them as an lawyer! :D
