Does anyone have a good Outline for a letter to arrange payments withe CA. I tried to arrange monthly payments but they said the wantit in full or i will get a summons to go to court. This was my first converstaion with them. i want to send a reg. letter to prove if we go to court that i made an attempt to pay. I am just bad with word so if someone has an outline for a letter like that. ty

collection agencies mostly don't accept any payment arrangements. This is because they are asked by creditors to collect a fixed amount minus their collection fees. They will collect the full balance. If your negotiations are good, they may agree for 80% of the total.

If your account is not sold by the creditor to the CA, you can work out a payment plan with them and won't have to deal with the CA in between. Use this sample letter as per your requirements.

Creditor:

I recently obtained a copy of my credit report and noticed that your company has reported me as having the above listed account as: (delinquent, sent to collections, etc.). I wish to bring this account to a resolution that will be fair and beneficial for both of us. Therefore, I propose to pay you X monthly payments of $, or forward a check to you in the amount of $ as payment in full, provided that you are willing to send me a letter stating you will report this to any and all credit reporting agencies as: 'PAID AS AGREED' or notify me in writing that you agree to delete this item from any and all credit reporting agencies.

I WILL NOT agree to accept a 'PAID P & L' or 'CHARGE OFF' for an additional amount of time on my credit report. It is my position that I have suffered enough as a result of this problem.

Upon receipt of your letter I will send you a cashier's check or money order in the amount of $.

Sincerely,

Call the original creditor and see if they can work with you. If they accept payments from you, there is no need to deal with the CA. In that case, send a C&D letter and stop all communication from them. If you have no choice but to deal with the CA, get the debt validated before sending your money.

I did try talking to the CA, It was the very first time I have spoken to them, And they Refused to accept anything less then full payment which is impossible for me at this time, The plan i came up with would have them paid in full interest and fees in less then a year, i know its long but i thought if i made the effort to show i Wanted this debt repaid they could work with me. Guess not, But i will try the creditor and see how that go s , thanks for your great advice.

Well I sent the letter today, Only problemwas the lady i spoke to at the post office said i couldnt send it registerd mail because this CA is sent to a p.o box, I tried getting a diffrent adress but found none, I will wait and see what happens, I did keep copies and i sent a payment with a money order so if it gets cashed i will have the proof, I also told them i would like a reciept and new balance everytime i give them payment or else the would not get any more money from me...so if the wish to get there money in a timley fashion then they should send that to me after each payment. I also told them if my situation changes i can pay it off quicker. Here is to hoping they will work with me
