Right this is for a payday loan, and an internet one at that. Everything was ACH debit.
Send the letters to the CA because you will be following the law
Send the letters to the CA because you will be following the laws as an informed consumer. When the CA receives the letter, it is their responsibility to prove with the details of the account. If they still continue to call without validating the account, speak with an attorney to sue them on charges of violating the FDCPA.

I dealt with a "greg patton" from AS & Associates. He gave me the same speech about filing check fraud charges. I asked for validation of the debt and he faxed it to me a week later (wasnt valid) and called my place of employment and was very rude to me and told me that he was going to close this "investigation" the following day. I filed complaints and also sent a cease and desist letter to him. I have yet to get an accurate total. My pdl was from nation money store as well.

If I live in Wisconsin do you think I should send a letter requesting this be marked as paid in full or should I let sleeping dogs lie, since it's been a month now and not a peep from them. I was looking for more information on this company and their tactics - they contacted me yesterday with the same demands and threats that you listed. How did you handle them, and what was the outcome? They are demanding $860 within 48 hours and I am trying to see what my options are. She also told me she would file charges if not received in 48 hours.

Joie75- When "greg Patton" called and harassed me and told me that he was going to file check fraud charges on me in april. He said the same thing. I argued over the phone with him about him not sending me anything in writing to validate it. 5-7 days later I got a fax from them saying that I owed $ 570.00 on a loan that I had paid back in rollover fee's which are not allowed in my state. The fax was inaccurate and I sent in a Cease and Desist letter- I also faxed it back to him that day. I filed complaints against them.
Sleep tight tonight knowing that they cant do anything to you. You will not be arrested/charged with check fraud. It's just a scare tactic.

collection agencies that threaten legal action that they can't use are in violation of the fdcpa and face charges. File a complaint against them with the FTC. Have you sent a certified return receipt cease and desist letter and a debt validation letter to them? Do not conmmunicate with them in any way other than the Postal Sevice Certified mail. If they call tell them that the conversation is being recorded and if they continue to speak they are agreeing to the converation being recorded. Watch how fast they hang up. This is a real old thread so if you said so earlier I am sorry for asking you to repeat.

Just wanted to thank you guys for your advice. I left work yesterday in tears thinking I was going to be arrested!! After reading your posts, and doing some investigating online, I now feel like I can stand up to them. I faxed and mailed (certified) a debt validation letter, and I filed a complaint with the FTC. Any other suggestions are welcome....Thanks again!
