I got a validation letter from A S & Associates

Last week I got a call from a Greg Patton from this company he said that I had committed check fraud the whole deal.....I told him send me something in writing and he never did. Today, I get a fax from this company with the amount of 572.50 he claims I owe for a loan with National Money Store. I know that IN does not allow rollovers. I dont know for sure how much I have paid but I know it rolled over SEVERAL times and they debited my account each payday. I dont know what to do. I looked up A S & Associates on the BBB and they have a satisfactory report. - 9 complaints against them. What would you do?



This is the first validation letter/fax I have gotten....is it suppose to say what I have paid towards it? It just says the amount I owe....


Tweety, the fact that they say so is not a validation. Send them the letter found on this website that asks all the pertinent questions. I am assuming that he is a third party collector. Is national money store one of those storefront loan companies or an online PDL? Did they send you a copy of anything that you signed? Go online and print out your bank statement showing what you have paid. Send this proof to him and state wht the law is in your state. Be sure to block out any personal info that you don't want a stranger seeing. Do this only after he has responded to ALL of your validation requests. Pretend he is Sylvester!

The validation letter should cover the following points mentioned in the fdcpa.

The information in the letter doesn't seem to be complete if it's only saying the amount owed. Write a dispute letter with the link to the FDCPA. Send the letter through certified mail with return receipt requested.

That's not a validation letter (though they'll want you to believe it is). That's nothing more than verifying that they have a debt with your name on it and your fax number. Follow through with the suggested letter of validation. I would also include the fact that they might already have committed violations of the fdcpa by suggesting you'd committed fraud. If they are debiting your bank account, close it and open a new one -- at a different bank.

Calling you at work or at home after you have informed them in writing is a viloation of the fdcpa. Get that letter out.

Yes, your payment history and rollovers should be included. Somewhere on this site there is DV letter that refers to a particular court case where it was determined that this is required. I need it for my letters also but have not been able to find it. Can anyone help Tweety and myself find this letter? And can it be put into the DIY file?
