A lawyer with Asset Acceptance has filed a pre-trial discovery over an account they seem to have acquired from Aspire Visa. I am fairly certain it is out of SOL for our state and want to verify this with Aspire. I am going to send of the certified validation letter to AA in a day or so. I simply want to send any certified letters all at once.

I have googled Aspire Visa and have read they are not easy to contact and frequently refuse to verify accounts that have been charged off or in collections. What are my rights in this and how do I go about attempting to prove that may have refused to provide me with factual information?

Also, if they had a leg to stand on wouldn't it be an acutal court case instead of a discovery?


I don't have the answers to your questions but I can tell you that Aspire Visa is one of the worst companies in the world to deal with! They dodge any questions you ask them or answer your questions with other questions and then send you nasty grams in the mail....Somone will probably come along to help you with your problem..

A validation letter does not get sent to original creditors since fdcpa does not apply to them. Send a personal handwritten letter to them asking for an accounting of your account with complete payment history.Simply tell them that under the Facta provision of the fair credit reporting act,you are exercising your rights to receive account info directly from the data furnisher.Send it certified return receipt mail.

That is exactly what I have read. My story is like many others got myself into debt unintentionally and then my ex husband lost his job. During that time or electric was even off for 2 months. :( It was a nightmare. I have nothing for anyone to take. I thought shame of having bad credit was punishment enough....and had the hopes of at least it being cleared after 7 years and a hard lesson learned, now this. :(

I ran my credit report and aspire doesn't even show up does that mean that it is past SOL?

Thanks for the help Cajunbulldog. Do you know off-hand which section of facta that my right to information falls under? I would like to quote it in the letter. Can anyone verify this address as being the one I send the letter to and should send it to a addressed to a specific department?
