Need some help with LNVN Chain of assigment.
The chain of assigmnet title is Resurgent Capital Services Account ownership and in the folloring grids it says:
Grid #1 legal seller citibank SD and purchser Sherman Origiantor III LLC and then transfer Grid# 2: and in this section it shows: Group....Batch Type Owner date Description
Sheramn Originator III
Sherman originator LLC
LNVN Funding LLC
in the date section all have the same date i.e 01/01/2008 and in the description section its shows transfer.
LNVN is the one suing to collect. In the Bill of sale, there is no mention of Resurgent Capital services rather it says the purchaser is Sherman originator III LLC and the bank that the bank does hereby transfer, sell, assign conveys, grants sets over and delivers to Buyer ,who simultaneously transfers, sells assigns....etc to LNVN. The Bill of sale does not have the specific account info. Also the puchase date is different that the the assigned date. There is also an notorized affidavit form an employee of Sherman Originator III LLC pointing out that the subsequent transfer to LNVN Funding llc, affiliate of Sherman Originator III LLC was in error.
How do I defend this in a few days?
Questions:
- Does this seem to be a legal assigment chain? I think there is a bunch of wholes in it but want a second opinion. What d you think? Too many names to be clear for me.
-The lawyer representing LNVN send a few statements me a fews statements that look like they may be from the originao creditor. Howver I notice that the type of card I have does not match the type of card stated on the statment ( The numbers match but for example I have a Sears Gold Master Card and their statementS although the itemized charges match, it says Sears Mater Card without any credit card contract or card agreement).
Do you think this will be admissible in court. BTW in my disclosure statements I did say I will present my statements. I belive both master card and Gold master card are governed by different agreements.
Any ideas on waht to attack firmly.
Thank you for your help.
