Whats the difference?

A few months ago I got a letter from an attorney's office regarding a clothing store credit card. I have been making monthly payments to them but I just realized that I havent made July's payment yet. I am curious what would happen if I mailed a payment today but they dont receive it until next week. Can they do anything like garnish my wages because they dont have a payment for July yet? Does an attorney have more power then a CA? I am concerned.....Thanks!


is this account current other than the july payment?if so i would just contact the attorney and say you plan to make good.an attorney collecting has to obey the fdcpa just as a CA
would.hope that helps.

edit:how long have you been paying on this?

i would let the attorney know that you plan to make good,i speak from experience.the time it takes to put in a garnishment
it wouldn't make sense.let him know asap though.

Tweety if you have always paid on time and just happened to forget this payment, call the company and explain what happened. I was in a situation such as this at one time, called customer service, explained what happened so they removed the late charge and also removed any record of me being late. They will only do this one time as a courtesy though, at least the clothing company I had a credit card with. It might be worth a try. :)

OK- I just called the company and I spoke to a lady, gave her my name, account number and explained my situation and she said - you cant just call here and tell us WHEN you are going to send in a payment...she wanted a check over the phone. I refused and she kept on yelling at me so I hung up on her....GREAT!!!!!!

I don't understand why an attorney would contact you for this card, when July isn't even over yet, well, it will be tomorrow, but still..

When they contacted you a couple of months ago, was it for the same card? I haven't had attorneys' contact me, except when it was turned over to the collections, or I was really late, like 3 months. I think I would check into that one with the store, just keep calling someone until you get a nice one!..karen

Even if its a JDB I would still make the payment via mail per your agreement even if it is a couple days late and then wait for their reaction. It is obvious that they are worthless on the phone so that seems to be the only option here. I suspect it will just go through like normal but you never know with those bozos.
