I need to send out a debt validation letter, as I am currently being sued by a CA, however, the summons does not show an address for this particular CA and before rcv'ing the judgement I never rcv'd any letters from this CA...I have rcv'd letters from other CA's on this debt, but not the one that is suing me...can I send it to the attorney representing this CA? If I'm sending to a lawyer is there a sample letter someone can guide me to, please?

that is not correct, from how the OP's post reads. It would seem that he was served a summons properly, its just that the summons doesnt list an address for the debt collector thats suing him.

The fact is this, a DV letter will be a waste of time for you right now. What you need to do is answer the summons by denying all of their claims that you owe the debt. Then, you need to file a motion for discovery and request proof of their claims. They wont botehr answering a DV right now because they already filed suit, so the only way to get them to prove the debt is yours is to motion for discovery in the lawsuit. They are not required to send you collection letters before filing a lawsuit.

Thanks for the responses...my court date is 8/24, so is it safe to assume it's too late to send a DV letter??

I rcv'd papers from the courts that state this is set for MEDIATION...it also states that during mediation I can't request discovery...WHEN WOULD I BE ABLE TO DO SO...if I want this debt validated before going any futher what should I do in the mediation?
