Hi people thanks for the help with the demand letter now I have one last question on this please, I sent a demand letter to Burgess law office in NY, they are brutal! they told me I was going to be arrested and yada yada, I looked them up and apparently they are trouble, the attorney general wants to be notified about there tacics and they have been to court many times, google them if you like you will see their work, but anyway back to my question, I sent a demand letter on Dec. 2 2007 and now it has been 30 days and I havent heard from them , I gave them 30 days with that demand letter and now what do I do? they didnt make any effort to contact me or answer my demands, now that time is up I dont know what to do, any help is very much appreciated! Thank you guys so much for your help thus far, bamma12

If you are talking about a debt validation letter, in NY there is no time limit for them to send it to you. I am also from NY. However all collection attempts must stop until the debt can be validated. If you dont hear from them that may be a good thing. Possibly they can not validate. Do not contact them. Again 30 days does not mean anything.

It is known among other consumer boards as the one two punch for collection agencies. Basically you send dv certified return receipt mail and when you get your green signature card back, you send a written dispute to the credit bureau certified return receipt mail saying you don't recognize this account. Now the collector is in a box trap where he must validate within thirty days or face deletion of account on your report. It is also a way to watch them trip up on improper reporting and then you nail their hide for their violations of both fdcpa & Fcra. The Fcra has some sweet penalties built into it once you learn to use it effectively.
