How to handle an attorney collecting a debt

How do I handle an attorney's office who has obtained a judgment for a credit card debt? I need to make sure that the debt is settled with the card company and will not later come back and say I still owe them.


Usually, judgment doesn't happen without court orders. Did you go to the court regarding this case and the judge asked you to show up your defense? I assume this attorney is trying to make you pay the debt using some fake legal papers. Check with the local county if there is a case filed against you. Call the creditor for your payment arrangements. Once the debt is paid, ensure that you get the PIF letter marking the account closed.

I followed legal aid advice that if I owed the debt, to avoid even more legal fees and charges, to not respond with filing in court. So, I was not only not notified of the judgment, also not notified of a court date. During a phone call with the atty. office, while trying to negociate a payment arrangement, I was informed of the judgment. By not responding originally, I apparently gave up the right to be notified with official court papers. Do I simply request a PIF letter from the atty or the credit card company?

Looks like you got some bad advice from legal aid. Whenever you are notified of a court action, you should always respond or show up, no matter what. That way you preserve your rights and you have an opportunity to negotiate payment arrangements with the original creditor or their legal representative. I would suggest that you talk with the attorney, tell him/her what your situation is and what you can afford and come to a realistic arrangement. Once you agree to make the payments, stick to the arrangement until it is paid off. If you have unforeseen circumstances come up causing you to miss a payment, be sure to contact them and let them know when you will be making the next payment. Always stay in touch and don't let things fall through the cracks. Once the debt is paid off, INSIST on a PIF letter.
