Collectors snatching money from bank accts.

Hello,

I am a caretaker for both of my parents of whom are very ill. One has altzheimer's (severe stage) the other has congestive heart failure. Both take meds on a monthly basis totaling $350 - $400 a month as well as the cost of their groceries. I asked some family members to help with the cost until I can find affordable prescription/drug coverage for them. Anyway, I received the money thru a bank account that was opened for that purpose under my name. Unfortunately, when I went to buy their meds and groceries, used the bank card, it didn't go through. I came home and went online to see what happened to the money. Lo and behold the money was there but it was put on hold! I called up the bank and was told that when this happens it means that either am being sued or someone is trying to collect a debt and that is the reason why the money was put on hold! I am just dumb founded..... My parents won't have their meds nor groceries. I don't know what to do now.

What can I do to stop this from happening again???


First, unless it is a wage assignment, they can't just willy nilly go into your bank account. They HAVE to have a court order! As soon as possible you need to write up a letter revoking authorization and fax it too your bank just in case.

You need to ask the bank WHO has put the freeze on your account and then you need to call them and get details.

If you were sued yet were never served, then you need to get to the court immediately and file to vacate judgment due to improper service! However, the above poster is right in that if you were sued and just ignored it, then they can go into a bank account in your name.

If this is the case you may be able to get affidavits from those who gave you money for your parents explaining that the money was never yours, but was for the care of your parents. I am not sure that will help, but it can't hurt to talk to the judge and give him/her the affidavits....he may lift the garnishment order for those monies.
