Your bank should be able to credit you for the withdrawal. If you are a good long standing customer with your own bank they should help you out. As long as they confirm that the other bank's ATM screwed up they should credit your for the withdrawal while they wait for Herring Bank to pay them back.
As someone who works in financial services (hopefully not much longer when I get my master's next year) I never use ATMs that have those old fashioned screens or are in a gas station, etc. Look for an ATM that is from a national network like allpoint or something. Or use a national bank's ATM. Better yet, go into your own bank and use a withdrawal slip :)

LOL It had to be cash because I was getting the last of the stuff I had pawned to pay bills when things got rough and they don't take credit cards or debt cards. I thought it was a safe atm, it was a bank branch atm. Oh well. I don't much like credit cards anyway.

You'll need to use cash sometimes. You can't always find a place to swipe your credit card. So, cash is okay. ATMs do pose such problems now and then. And the fact that your transaction took place in a bank where you don't have an account is making things a bit difficult for you. Well, what I believe is that you should take some and visit the ATM's branch. Talk to them about the problem as well as ask them to provide a fast solution.

The correct proceedure for getting your funds back if you dont receive your money from an ATM is as follows. You need to go to your bank and do a debit card or ATM dispute. The bank legally has 10 business days to put the funds back into your account, but when it is an ATM shortage you will usually get your money back the next time the machine is balanced. All banks that are FDIC insured have the same rules regarding disputes involving debit cards or ATM cards. You can ask your bank for the disclousure which explains disputes. ( You should have been given this disclousure when you opened your account) Hope this helped.
