Being sued by Lawyer out of Carrollton
Date: Sun, 10/30/2011 - 14:32
I have been sued. I live in Texas. I cannot afford an attorney. Help, please. What do I do next? The plaintiff says Cap One. It's all car of Michael J. Scott, PC. I don't believe that I ever recieved a letter stating that I would be getting sued, otherwise I would have been freaking out before now. The debt is about 2 and a half years old. If he went through with filing in the courts already, does that mean that he can verify the debt?
The odd part is, it's showing as a small business credit card, I've never had a business, much less a credit card for one. I'm confused.
I've nerver been sued before, I am completely ignorant about what forms to fill out, how to fill them out, or where to find them. I've been searching on line, and I'm overwhelmed by all the information out there, I don't know what to follow or not. I do not plan on ignoring this, but I don't want to do it wrong either.
It was filed with the local justice of the peace. There was a plaitiff's request for admissions attached. Do I turn that in to the JP? or do I send it back to the plainiff? Are there letters somewhere I can fill out? or do I need to write from scratch?
Should I sent a letter of debt verification to the lawyer now? Can I do this through the court? I was served last wednesday, I need to do something this week.

As you have received a summons from the court, you should make sure that you give a reply to it or they would get a default judgment against you. While answering the summons, mention that you don't owe the debt and that you would like the debt collector to validate the debt for you in writing. You should also be present in the court on the given date and explain your situation to the judge. This will help you in getting justice. However, after saying all this, I will still suggest you to somehow manage for a lawyer as he/she can guide you in dealing with this case in a better manner.
