please help!!Judgement coming!

We are scheduled for a court date on tuesday 2/18. We are being sued by Beneficial for a credit line that we could not make timely payments on. We had medical hardship and loss of income due to economy. we would make irregular payments but we made them. We had 2 loans before with Beneficial HSBC and paid them off in timely even early. Lawyers Finklestein, Kern, Steinberg & Cunningham. I wrote a letter describing our hardship and sent $100.00. I called last week and left message for someone to please call me to discuss case. No one called, I finally got to talk to my case attorney today and she said that I was lying, that I did not call. Anyway, they want all or nothing. My account was for $15,000 plus $2200 in all their fees. They are merciless. I have lost wages taking my child all over the united states to doctors, trying to find someone who can help him. My husband's income dropped from $42 K to 27 K in less than a year. This has been a horrible year for us. How sympathetic will a judge be? Is there anything that can stop this judgement other than paying it in full - which I cannot do. We are trying to sell our home specifically to pay off this large sum because we feel hopeless right now. Does anyone have any wisdom to advise us? Thank you. Tired and hopeless

The judge should be sympathetic. You have a strong case. You attempted to make arrangements that were more suitable to your financial situation, which they refused. I hope you mailed that hardship letter Return Receipt Requested.

Just make sure you word everything properly. You can search this site for filing responses to judgments. Gather all your documentation into one place, including the expenses for your child.

Don't give up your home. The market is too bad right now, anyway. You should get a good payment plan through the courts, and maybe - just maybe - you'll win a reduced amount.
