CA's never replied to DV requests/ Blitt & Gaines is now involved

I took the advice of the forum and sent numerous CA's debt validation requests. None responded. Account just kept going to different CA. Now Blitt and Gaines has account which has been charged off and is threatening to sue if I don't pay them $10,000 of the original 11,000 which has now gone to almost 14,000 within 7 months which I am disputing.

What can I do? I would have settled when I was offered a $4,000 settlement but I never got validation. HELP! :shock:


You should not make any payment unless you get the debt validated. Moreover, a creditor cannot sue you legally and bring judgment against you till they validate it. If the creditor cannot validate the debt, it means that they do not own it and they are trying to collect it illegally. You should not negotiate for debt settlement before debt validation. If they harass you further, file a complaint with the FTC.

The recording at the beginning of the calls for Blitt and Gaines states they act as a CA but they're supposedly a law firm. I did look it up. Can they end up suing me like they say? I've only received two calls from them but no letter letting me know they now own the debt. Should I just send a DV letter to them as well or should I wait to get something in the mail first?

Also, no prior CA has validated debt and it keeps going to a new CA and the amount keeps going up! I'm afraid that when and if I ever get validation, the amount will be outrageous!

Have you spoken with them yet,or are just letting the recorder answer it? If you haven't spoken with them, you need to answer,tell them they need to send you a letter within 5 days and not keep speaking with them. If I am wrong about this, someone will come along and give you other info.

After they contact you,speak with you,they have 5 days to send you a letter. Then send out yet another DV.

I had one CA not validate-kept passing it around and around. Every time I sent the new one a DV,I sent copies of the old ones I had already sent to the others telling them this debt wasn't validated.Be sure and keep copies, notes,etc., of correspondence..Good Luck..karen
