has anyone ever heard of or dealt with forster & garbus law firm in ny before?

so " guest " you say you sent a letter to the office saying you couldnt pay, but before you said you were paying ??? and then you expect them to call, when its YOUR bill? then you claim to have not been served , but you were paying your bill having contact with them obviously you had some idea....

so if you had a car loan, would you send the bank a letter saying you couldnt pay and expect them to call ??? NO your car would be repo'd ....but oh wait the repo guy is just doing their job ....just like f&g, but ooooo no you are trying a class action lawsuit and make up lies that you havent been served .....meanwhile , 3 copies are always sent of a summons in regards to a debt

A guest using the name no comment left this on my page:
oh really?? your threatning to kill me is that right, maybe i should get an attorney and start a lawsuit against you

If he/she/it wants to file suit against me they my certainly file. But I'll get it dismissed because the plaintiff will not be able to show cause, let alone determine where to send the summons to. "I'm gonna sue you even though I don't have grounds to do so, even though the judge and defense council will laugh me out of the court room"

But to answer your question, sometimes it seems so. I know that in order to practice law in a state you have to be licensed with the Bar Association with that state (which seems to escape many of them)

Unless licensed in a particular state no debt collector shall engage in conduct deemed the practice of law. Without limiting the general application of the foregoing, the following conduct is deemed the practice of law:
(a) The performance of legal services, furnishing of legal advice or false representation, direct or by implication, that any person is an attorney;
(b) Any communication with consumers in the name of an attorney or upon stationery or other written matter bearing an attorney's name; and
(c) Any demand for or payment of money constituting a share of compensation for services performed or to be performed by an attorney in collecting a claim.

What about showing cause or following proper service procedure?

An "Internet troll" or "Forum Troll" or "Message Board Troll" is a person who posts outrageous message to bait people to answer. Forum Troll delights in sowing discord on the forums. A troll is someone who inspires flaming rhetoric, someone who is purposely provoking and pulling people into flaming discussion. Flaming discussions usually end with name calling and a flame war.

So you resort to flaming and a very poor (and failed) attempt at impersonating me as your response? Your a troll. I'm done talking to you.

Could a forum moderator please lock this thread, delete the inflammatory remarks (including my own) and ban his mac address?

Uhhh No. You're uhhh wrong.

1. In my letter to them I told them to only contact me by mail and they did not.
2. I always intended to pay, suggested methods and I informed them of this however they did not respond.
3. Three copies where not served. Unless you think I have a twin at home when I was really at work,...my nonexisting neighbor existed only for one day,...or maybe it was the mail man who decided not to give me a copy. Funny how three separate occurences ended up with the same result, nothing. What are the odds of that?
4. How do you explain that this exact same scenerio was played out with numerous people from the same firm? Don't believe me, look it up. I guess you still beleive in the fantasy that F&G are always on the side of fair and right...

oh please, its not them manipulating people, its that people like you dont know how to own up to your responsibilities, you can never admit you are wrong, it has to be pointed else where.

so they are the bad guys because they are trying to collect $$ you owe? some of them can be cruel , it happens, the same way there are crooked cops, no one is perfect

Speaking of service procedure. Does anyone happen to know if there are any states that allow service to be delivered via postal delivery service without signature requested?

Every state I have researched so far (and municipalities where applicable) require some type of certified service (requiring signature upon receipt) or are delivered via process servers or law enforcement.

What state do you live in guest? I would like to research your area requirements for serving process.

whoa what is all this going on. listen guest, dont pay attention to any of it, do as jcemt said, if you have not been served PROPERLY then yes , if you go to court , the judge would have to vacate the judgment BUT it is a valid debt, you would be put on a court stipulation , but affordable to you, trust me the judge will work with you, not against you

people get in debt for a reason, because they are in a bad financial situation, its a terrible thing being in debt and the calls every day remind you that you havent paid your bills , but just remember that things could be worse, and make the best of what you have.

________GOD BLESS AND HAPPY NEW YEAR!

Topic locked and I will remind everyone including myself to reread our rules. I myself did toe the line a few times and I am sorry for any hurt feelings. Jcemt you did well and see no reason for any actions to be taken against you.You were trying to keep the topic running and battling drama at the same time.
