I had a Mens Health subscription a while back and after one time of not ordering a book, I paid for it. They contacted me about other offers and I told them no I do not want anything else from them and to never send me anything again. Well a month later I get 3 books that I did not order. It has been about 7 months, I still have the books because you have to pay to return them and I will not do that.

Luckly I found out that in 2005 there was a class action lawsuit against them for this same thing, sending books to people who did not order them. Under Federal Law, if something is sent to you and you did not order it, you get to keep it for free or return it for free, at least that is what it says in the lawsuit.

So the latest letter I got from them states my legal rights, lol. They say if I do not pay they will get a collection agency after me,,,,,,,I am scared,,,ooooooo. I can't wait to see where this goes.


Once this gets on your credit report you will have alot of effort put into getting it off. While you may be right about the class action and the returning (r not returning ) of unordered merchandise, it may end up going this route. The send it to collections, list it on your report..then you have to take the time to dispute the items..which they will probaly validate and therefore it will remain on your report until finally after years of interest it will go in front of a judge who will tak it from there..it maybe easier and cheaper to give the scums back their books. I know I would definately call the atty general in your state who usually will make an immediate call to them. Once th atty gen. talks to them they may be very willing to send a postage free label,in which you can return the books at no cost to you...Also call the FTC. This will really let them know your serious.

Keep on top of it. It is established fact that companies use the credit reporting system to force payment out of you for fear of marring your credit. Don't be a victim. You should immediately send them a certified letter explaining the steps you have taken thus far (contacting the proper authorities) and that you never ordered these books and if they will send you a postage paid envelope you will be happy to return their books. Also inform them that putting this on your credit is against the law because you enver ordered these so you are not financially responsible for them and if they violate your rights one iota, you will be filing suit on them and will also bring into evidence the class action lawsuit already on them.

THAT might make them stop and think. Also be sure to keep an eye on your credit reports.

Generally when you sign up for one of these clubs all you have to provide is name, address and method of payment. If they don't have your SS# then I don't see how they can get it on your credit report. There is certainly no harm in jumping through the hoops mentioned but I really don't see any recourse they can take if they sent you the books when you did not order them other than maybe harras you over the phone. Personally, I would probably package the 3 books up in one of those $3 boxes and send them back with a cease and desist letter. The $3 is probably worth the hedache it will avoid in the long run. If they sent you any more after that then I would keep them.

Believe it or not, you did order the books.

Most order cards have (small) print declaring that by sending in your original order (be it magazine or a one time book order) you agree to preview an annual series book for 21 days. A few weeks before the book is due to ship to you, customers receive a card stating that if they do NOT want to preview the book, to return the postage paid card and it will be cancelled. Most customers disregard this card.

Then the book is shipped and most customers say " DID NOT ORDER THIS!" when really, you did with your original order for the mag or for a book.

Your best bet in this situation is to read and fully understand the terms of your original order. If you get a "negative option" card (a card telling you to return it to cancel the program) - then send it back. Lastly, if you DO receive a book you believe you 'did not order', then mark it "DID NOT ORDER -REFUSED" and return it to sender - you won't pay a dime.

thanks hellothere..

I did return the card saying I didn't want any books. When they called I also told them this. Massachusetts has some strict consumer laws against practices like this, such as not clearly disclosing that a consumer agrees to preview books. If it is in small print not easily noticable, it is illegal in MA.

I will say that I have not heard a peep as of yet.
