I've never even heard of borack and associates... But if they're representing LVNV, they're likely slime, too. Where are you at with them? Initial contact, judgement, somewhere in between?

unclewulf, i got a notice of intent to dismiss for lack of prosecution on court's own motion at the beginning of the month. i called the courts to make sure it was legit. the operstor told me that i didn't have to show up because most likely the case will be dismiss.

i was at my parents house and picked up the phone. borack and associates telling me they are representing LVNV and that they have a summons out to be servics to me. an attorney was not present and they could not give me any information expect that i owe about 2.5k

i told her i will call back tomororw. wise move on my part?

the intent to dismiss was sent to my old address and forward to my new one...i no longer live in the city that they will have the hearing at....should i go anyways? it is like a 2 hour drive.

That sounds like improper venue to me. They have to sue you where you live. Same county, at least.

i just read your thread. this is so riduculous. my intent to dismiss case hearing is on june 11...i am so lost after reading your thread.

You can get this case dismissed easily and make it so that they have to sue you in your home county as they should. You just need to respond with a motion to the court where they have set the hearing for dismissal due to improper venue.
