Brady and Caruso

I received a call from "Brady and Caruso" concerning a debt from a credit card from 1996 with my ex-husband. I supposedly owe over $8000 that they will be "garnishing wages and reporting to the IRS." My husband told them they needed to send the documentation and serve us if they were for real. We noticed immediately that the "lawyer" Mr. Rice had horrible grammar..."I don't want to break no rules.." etc. Ironic that he would say that when they are so illegal.
I called "Mr. Rice" back, informed him I knew nothing of this debt, was not paying them a cent, and he can serve me if he wished -then HE hung up on ME!
I will report them to the Federal Trade Commission and Arizona Attorney General Offices. It's unfortunate that people fall for their considerable scare tactics.

If the debts are as old as you say, more than 3 years since you made a payment, then that is why they are threatening you. The statute of limitations in your state is 3 years from last payment date. What they do now is threaten you into making a payment to re-start the statute of limitations, if that is even possible might have to be in writing. Once the SOL is restarted on an OLD debt they then will try to sue people. It is a shady trick and if people know their rights they can beat it in court. All they have to do is state they where threatened to make a payment.
