I had to open my big mouth!

I think I posted something here last week about the fact it had been a long time since I had received any collection calls. Well, I guess I jinxed myself!

I got a crazy VM from "The Law Office" this morning at 9:30 AM on my home phone and cell phone. Besides all the cliche'd CA foolishness and the multiple FDCPA violations, the caller mentioned something about a "pending legal matter in Los Angeles county."

I do not now, nor have ever lived in Los Angeles County. Last I checked, there is not now, nor has the ever been, a Los Angeles county in Florida. If she's going to try intimidating me like that, can't she at least get the county correct?

Of course I called her back and the phone conversation was entertaining to say the least. She refused to give me their address and kept telling me the name of the CA was just "The Law Offices." She finally told me she would have a manager call me back and he would "give me everything I ever needed" from them.

Not sure what she meant by that; however, if she was referring to the winning lottery numbers, I'll take them!

I did call back and got a helpful guy on the phone who knew exactly the collector I was talking about when I started listing off the FDCPA violations she had already racked up. He did give me their address and advised the initial dunning letter would be going out ASAP.

Like I'm holding my breath waiting to receive it. They're getting a DV/partial C&D letter from me as soon as I can finish typing it.

Funny thing, I had to call back again to get their fax number and the woman that answered that time called their company "The Legal Offices." I guess they must change their office names by the minute, or something.

Oh, and the supervisor has yet to call me back and "give me everything I ever needed." I was hoping to go out and buy those lottery tickets this afternoon!


don't know about the proximity to buffalo,but NY is becoming another bottomfeeer haven.just like your homestate of FL.

Yeah, it's almost embarrassing being from Florida, especially Jacksonville, FL, with all the psycho CA's that originate from here.

I should have asked that first chick if she went to that bar that was in the hidden camera footage on DateLine. See what response that would get from her.

When I told her I already had enough FDCPA violations just from her message on my voicemail alone to sue her company, she seemed to stumble on that comment. She sure didn't have a snappy comeback ready like she had for anything else I said to or asked her.

Follow up.

So I never got my initial contact letter from these people, the one that is required to be sent within 5 days of the initial contact. So I sent them a friendly reminder of this fact and restated my request for Validation this past Saturday, May 9, 2009.

Well, a letter arrived from them today. The inside letter is dated May 1, 2009. Which would, on the surface, satisfy the law requiring notice being sent out within 5 days. There's just one thing they slipped up on though.

The Post Mark.

It's post marked May 9, 2009. Which is the day I faxed my second letter.

So, I just faxed them another letter, offering to settle with them for the entire amount being marked as satisfied-in-full (once they validate it, of course), and they will not sell it to another collection agency or I will turn over all my evidence to my attorney on May 29, 2009. Suing them for many FDCPA violations. Not to mention Attorney's Fees and Court Costs.

I'm also filing complaints with the FTC and Florida AG's office. Regardless of whether they accept my settlement offer or not.

I too would like to file a complaint against this "law" office but cannot get them to give me the address to their location. One person said they are in Buffalo, NY and the other said they are in Florida. They keep calling me saying that I owe some money for an installment loan that I never took out. When I asked for written proof of the debt the guy got really rude with me and told me that I knew I owed the money so I needed to call and get the information myself that he wasn't doing the leg work on it and that if I didn't get it taken care of that they would have the attorney forward this on and prosecute me. This can't be legal is it? Can someone offer adivice?

There's another one tricky to find. I get a lot of Conan O'Brien and Max Weinberg hits. I did find this though:

This is most likely Cambridge Huxley, afterlife of Giove Law. My attorney said they are new, no capital and not worth suing YET. Just don't answer they will never pursue, just trying to terrify members. Do to Bud Hibbs list they are on it under Cmabridge Huxley and Giove. Stand your ground.

If you offer a company a smaller monthly installment than they consider adequate, can you use this in court against them if it goes that far? (i.e. I attempted to pay on this date, they wouldn't accept payment) not that the debt would be cancelled, just wondering.

This so-called lawyers called me at a location where I don't live and left a message. No problem. I called them to set up an arrangement to send them payment directly from my work, but when I asked for an address to have the payments sent they told me they don't give out their address or accept checks. I am going to assume that they wanted me to give them my debit card number so that that they could charge what they want for the account. I asked them to send me the information about the account and they said that they had already sent it to a former residence. Also, she said that the amount of the so called debt was one amount and if they took me to court it would be double. The person I talked to, Alicia Harris, had the gall to tell me she was too upset, too annoyed to continue talking to me and put me on hold to get a supervisor. At this point, I hung up. What con artists.

They too are calling everyone in my family, as well as violating the fdpca stating that a judgment will be filed at my local court house. Is this a legit company or just another scam? I have called back but get an answering machine for a Timothy Peters...any Advice??

If they're violating FDCPA like that, do you really need us to tell you that they aren't legit?

A strongly-worded DV letter is in order here, if you can get an address to send it to them at. The law says it has to be in writing, which is why some of these places are so cagey about giving you a mailing address.

Have they sent you anything in the mail? If so, send your DV to that address. Failing that, remind them that they have five days to send you something in the mail. In extremis, ask them this: 'If I were to send you a money order, where should I send it?' As long as the 'if' is in there, it's a hypothetical question, not a promise to pay.
