I know I should have done this sooner but I just found this website. I have received a small claims complaint court in New Hampshire for an old credit card dept. I paid a lawyer in Texas $75.00/month for years on this debt. The amount was down to around $1,000 when I stopped. Now they claim I owe them $5633.37. I know I have to answer the complaint by June 1st. I'm tempted to ask for a jury trial but I don't want to seem like I'm waisting the court's time. I could use some advice. I have copies of every payment I made.


Do you live in New Hampshire? If you don't you need to mention that in the complaint and get the case dismissed due to lack of jurisdiction. That will buy you some time.

You may be able to ask for a jury trial, depending on NH's rules of the court (if you live in NH), but typically jury trials are rare in civil cases. Plus, unlike most criminal cases, you have to get a unanimous decision from the jury. I say this a lot, but the best (and legal) advice you can get will come from a lawyer licensed in your state.
