Don’t know how to give a reply to summons

I have received a summons for a credit card debt. As per the summons, I have around 30 days to validate debt. The SOL period in Patterson city of California is 4 years. It will expire in the next month. This is the first notice I’m receiving about this credit card. The OC didn’t send me anything till date. What should I do?



answer the summons.any answer. they filed a lawsuit so the SOL won't help you.btw once you become deliquent creditors differ in how they handle the debt,but you must answer the summons.then see what if anything can be worked out prior to the courtdate.

Well they have filed within the SOL so you cannot use that as a defense. Is this your debt?? DO you have any valid defenses?
If not, they are going to get their judgment..best you can do it settle this before it gets to court or make sure you show up in court and get a payment plan that allows you to make payments without them garnishing your wages.

You can go to http://www.courts.ca.gov/selfhelp.htm and through the site there is a way to fill out the response form online which you can then print out and take to the court to file it. Go to the small claims advisor site for your county.

1. Documentation from the original creditor that indicates I made the purchase(s)

2. Documentation from the original creditor that indicates I owe this debt

3. Documentation that lists the total principal amount owed

4. Copy of the final account statement from the original creditor

5. Document that lists the original amount unpaid minus any charges and or fees

6. Document that lists out each additional charge or fee you claim I owe

7. Total for each charge or fee and the date each was incurred

8. Description of why I must pay the additional charges and or fees

9. Legal proof that “YOU” now own this debt

10. Amount “YOU” paid for this debt
