Hall, et al. v. AT&T Mobility, LLC et al. CIRCUIT COURT OF COOK COUNTY, ILLINOIS, COUNTY DEPARTMENT, CHANCERY DIVISION No. 2:07-cv-05325-JLL-ES

In recent years, California courts have ruled that certain ETFs are illegal. Millions of dollars in class action lawsuit settlements have been awarded to California consumers who incurred illegal ETF charges from wireless carriers like AT&T, Sprint, Nextel, and Verizon Wireless.

They at Collection Company of America have on my CR (though they have never contacted me in any way) that I owed them over $800.00 for what AT&T said was an ETF for my alleged one month until end of contract early termination even though this alleged amount owed is no longer a valid debt they can claim per court ruling.

Any ideas what I should do? As I said, they haven't ever contacted me, they just have the alleged debt listed on my CR's and it is scheduled to continue on record until early 2015.

I have not contacted them and no, I was not part of the class action because I did not pay the early termination fee, I have only been charged it by AT&T (in early 2008, one month early from end of contract). (plus I believe it is past SOL) (in CA)

" SO, I really need to know (still) is it legal for them to even have this (alleged) debt on my CR's? If the debt's were ruled illegal, wouldn't them having it on my CR's be illegal too?

Seems to me it is clear that it was because it falls under what was ruled illegal; they charged the full ETF with only one month left on the contract instead of prorating it. At the very most, all they could have placed legally on CR's was the prorated amount.
