I got a letter from Cambece stating that I have an outstanding debt owed to CACH, LLC. It is a debt that HSBC sold to CACH. I started to get phone calls from Cambece within a few days of getting the letter. They demanded payment in a lump sum, and gave me just 2 days to come up with a "satisfactory" settlement. A payment plan was refused, and I would rather settle anyway.

I sent a Debt Validation letter, CM,RRR on Monday. I'm guessing they got the letter today (Wednesday) because it is the 1st day they did not call. I talked to them once, when they 1st called, and was asked what I could do to settle the debt. The amount owed is almost 13K. They said their client would wave all late fees other penalties accrued and the amount owed is $9400. When I told them I would not have been in default if I had $9400, they asked what I could come up with. I told them that I could get about $3000 dollars in a few weeks time. Not acceptable. They gave me 48 hours to came up with a better solution. I was told to ask family members for the money. When I told them that was not an option, they accused me of trying to skirt the debt, and questioned my intention of paying it.

I was told "off the record" that the client will usually settle for "around half" if they get the money promptly. I have not had contact with them since, knowing they were about to get my DV letter.

I also asked for their license # that would allow them to attempt to collect a debt in my state (Wisconsin).

As of now, I have received nothing from them. As I stated, they probably just got my letter. I have not received the confirmation from the USPS, but expect it soon.

My question is, where do I go next? I have been reading other threads on here, and while there is lots of info, it's hard to piece it all together! If they can validate the debt and can legally collect in WI, what are my options? If they can't, what do I do?

If the collection agency don't validate the debt, then send a cease and desist letter via certified mail to them. Once they receive the cease and desist letter, the CA can't contact you further. If they do, you can take legal action against them. However, then can send a letter to inform you about any step they are going to take against you.

If they are able to validate the debt, then it will be better to settle the debts on your own. It is possible to reduce the total debt amount by 40% to 60% through debt settlement. If you're not able to do it on your own, then get help from a professional debt settlement company. They will help you settle the debt.

Make sure they validate properly...they are acting very shady by giving you 2 days to come up with money when you have 30 days to dispute the debt...it is known as overshadowing. Be sure they provide a final statement showing what you owe as well as a signed contract/agreement that shows that they may charge any interest and/or fees of any kind. You also want something that shows they are legally able to collect the debt.

You should NEVER negotiate a settlement, or anything until they properly validate the debt. If they refuse, tell them that you will not pay a single dime until they do and should they sue, you will demand that information in discovery and counter sue them for continued collection activity after a DV.
