Capital Management Services LP is trying to collect for CC account.They have sent me a settlement offer and it is a good offer and I want to send the payment but the letter is typed,not handwritten, and no signature and states:

"This company has been engaged by Resurgent Capital Services LP, the servicer of the account, to resolve your delinquent debt of $2001 and to make checks payable to Capital Management Services LP to adress noted."

BUT then below that it states:

"Capital Management Services LP is authorized to accept less than the full balance as settlement on account."Tells settlement amount and "is due in their office no more than 45 days after receiving notice."

I am not disputing or fighting this, it IS within SOL, and I DO owe this debt. They ARE allowed to collect in my state, and I want it paid and the offer is really good but is this letter enough that if I mail in the settlement payment that if they pop up and still say I owe more or they do not close account, is this letter enough proof of the agreement settlement? I know to mail a check but has anyone sent in a payment to settle with them and they done you wrong? I REALLY hate talking to them and just want to pay it.Suggestions, opinions?


1. Do they own the debt or are they acting on behalf of the CC company? Do they have the authority to talk for the CC company?
2. is the $2001 the total amount owed or less?
if less, get them to send a signed letter stating that this will be paid in full and they will not sell off the balance to any one else.
3. Send any payment by money order only, DO NOT give them any banking information.

1) They do own the debt
2)$2001 is very close to what the debt owed was when charged off,$1950, so a settlement of $600 is a good offer.
3)I had planned on sending them a check but the account is my moms name so they could not withdrawl anything from her account being she has nothing to do with any of this, but should I still pay by money order?

My biggest concern is if I just send in payment is the letter I have all the proof I need " incase" they try to pull something like they want more money,they never settled,or I paid wrong balance and so forth?

Yes it is still within SOL last payment 6-2006 and SOL is 3 years. Honestly, I am tired of the phone calls, letters, and just had another CA sue me in court for another debt and I lost in court,cause no matter how much I read up and did what was suggested and felt prepared and had my answers and and file dmotions and had proof they never validated the debt and such, I was no match for the attorney and the judge did not seem to care about those of use who had left our debts go for being unable to pay I was actually scolded for it and ended up having to pay 3 times the original debt!! So even though again I have proof they never validated account and some other things I just want to pay this and be done, tired of stressing over being sued AGAIN.I am sure the suggestion for a lawyer comes about now but NO ONE around here will take a case like this or even offer help they simply state it is not worth their time.

The letter I have from them has their company letterhead and all information on it just no signature but everything else showing their address, account #, their license permit # and such.I just know how crumby these CAs can be and I DO NOT trust them at all but here in good faith I am trying to pay I just do not want to be scammed.

I called and requested a letter signed by someone accepting the settlement and the rude lady said they do not do that the letter they sent is all they would send again and it was legit,legal, and what they send to everyone and it was all I needed if anything did arise.So they won't send a signed agreement just another of the same letter I already have.
HOW STRESSING!!!! Can't even just PAY without stressing they are going to screw me over! You would think these slimeballs would be glad I was paying and send a simple signed settlement letter!!

I have been trying all morning to call 800-767-7105 to talk to someone regarding a settlement, if you can help me with this and get this message today please call personal info deleted - ND and my husband will get me on the phone. If not today then tomorrow or after 7 pm during the week. I do want to take care of the settlement. Will be waiting to hear back from you either by phone or email, my email address is edited - ND
