being sued by debt collector

I don't know if anyone has experienced this or has any advice. I received a summons from a law office, it says it represents Capital One bank and that I have to appear in court. On the bottom it says this is a communication from a debt collector but no agency name is given. It's legitimate paperwork, but I'm in a very bad financial state. Will they actually sue me if I have no assests? I don't own anything. I am on worker's comp and I probably will be til the end of the year if my surgery gets approved. I'm getting paid 66% of my wages. It's not enough to pay my rent and my bills. If I get sued I can't pay any money. I know in Illinois they can garnish your wages. Would they really do that if i'm on workers comp? [/left]

They "are" suing you...it is not a matter of "will they". You might not have anything now but judgements are generally good for about 10 years...so they are looking to what you will earn/own in the future.
