Hi, My husband has/had an account with Capital One in the amount of 2600. He is a medical student and we live on student loans. He could not pay the credit card and defaulted on his payments. We have been trying for scholarships to help, but nothing is working out. Basically, we are paying 140 mo. to a debt consolidation agency. originally capital One would not "accept" the amount we wanted to pay but came back at 140 per month. We accepted and have been paying that amount. Then we get paperwork from Gerald E. Moore stating they are suing us and there is a civil action number. So i went to the court house website and sure enough there it is. The issue is that we moved out of the state where this is taking place. This originally took place in Georgia. We are now in Tennessee. It states online that he was served a summons, but he was not located. We want to pay what is owed on the account and that is all. (which we thought we were doing). I am afraid to have him call this Gerald Moore since i am not sure what will happen next. Should he call the courthouse and tell them he no longer resides in the state? Also, the letter from Gerald E Moore was dated Dec 22, 2010. We just received it a week ago!!! Please help!


You should contact an attorney and discuss the whole matter with him/her. If you have a settlement plan with the creditor/collection agency, then they can't take legal actions against you if you're paying as per the plan. Thus, your attorney will be the best person to deal with this matter.
