I owe Capital One Bank credit card principal amount $732.01. The collection agency is Hayt, Hayt & Landau in Miami, FL. I pay the same amt every month never missing a payment. Sometimes I may be late, but never, ever missed a month. Now they sent me a Final Judgement that I defaulted on my payments & want me to pay attorneys fees of $450.00 plus interest in the amt of $1,266.29, & post-stipulation attorneys fees of $300. with 8% interest! I have copies of all the cancelled "CASHED CHECKS" How can they claim I am in default when I never missed a payment?? I call it "legal" extortion!!! Please some one give me an answer. Thank you so much!


If you have the documents to prove that you have regularly made the payments, you can send them a copy as a proof that you did not default on your payments. However, if they still harass you for the attorney fees and late payment charges, you can file a complaint against them with the FTC.
