I have a Capital One account that has been charged off. I have been currently paying this account monthly through a debt management plan. I received an email from the debt management company when I enrolled that since my account was charged off, Capital One agreed to accept payments through the debt management company for payment convenience, and that if I did not pay as agreed they would continue collection activity. I have paid on time, every month the agreed amount. I even spoke with a collection agency Wm. W. Siegel & Assoc. when they sent me letters and explained to them that I was currently enrolled in debt management.
Imagine my surprise when I received a summons in the mail today from Pressler and Pressler for this Capital One account! They are giving me 35 days to respond. What should I do? I wasn't even aware that they bought this account and I'm still paying Capital One through my debt management.

You'll need to give a reply to the summons. Refute the allegations made against you in the summons with valid proof. Enclose all the relevant documents with your letter. Attend the court hearing date.

This is common with Cap One. They generally dont approve debt management plans...all debt management plans done in voluntary cooperation. Your debt management company should have told you that a law suit is possible. Once charged off, Cap one can sue you at anytime.
Be aware that the debt management company will not assist you in the law suit...they will not represent you in court.
At this point, a DV is useless.
