Hello,

In Feb '09 I disputed a very old ('03) paid in full/closed account with Capital One, which has negative notations on my credit report. Capital One validated this account with all three credit reports, thus it remained on my credit report.

In Apr '09 I asked for Capital One to verify this account for me along with the late payments. I called on this account several times to verify this infomation. I spoke with over 15 different reps, 2 supervisors, recovery unit and 2 account managers and no one could locate this account to give me any information. I even had a rep inform me in May '09 that she would send an e-mail to all 3 credit bureaus asking them to remove it, but the credit bureau tells me they haven't received anything and that it shall remain on my report. Over the course of 4 months I mailed and faxed verification letters to Cap One and have never received any response. The latest letter was sent to them via certified mail. I show that they've received it and when I call to check status, the reps just tell me to wait for a response or send another one.

It's not fair that Capital One will verify this info with the credit bureau, but can't verify or find the account for me. What can I do to have this account removed from my credit report. They've been no help whatsoever. Please help me.


Yes it is fair. Generally once an account is that old and is paid in full it is i the archives that CSR's cannot access. Verification is done electronically and the computer updates the CB's. Since it is paid in full, you are no longer a customer and they do not have to validate an to you.

You have the right (regardless of whether it's paid in full or not) to have Capital One validate the information you are disputing. You should always do this through USPS as CMRR so that you have a paper trail. You are entitled to a complete usage history of the account which will show any and all delinquencies. I recently submitted a validation letter to them. They will ask (if you don't already provide it) the following:

1. Complete name (as appeared on the account)
2. Current and previous (when the account was open) mailing address
3. SSN (or last 4 as a minimum)
4. Date of Birth
5. The account number in question (16 digits).

Along with this information, you must clearly explain what it is you are requesting. Advise them they have 30 days from the receipt of the letter to validate their claim and that they must either provide you with their documentation stating the validity of the claim, or they must provide you with a copy of the letter they will send to the CRA to have the negative information removed/changed.
